Terms and Conditions

These terms explain who may donate, what we may accept, and what happens to an item after Cline's Recycling accepts it.

1. Who we are and when these terms apply

“Cline's Recycling,” “Cline's Recycling Initiative,” “the fundraiser,” “we,” “us,” and “our” mean the family-led recycling fundraiser operated by Cody Cline and its authorized representatives. “Donor” and “you” mean any person or organization offering an item. “Items” means goods, materials, recyclables, books, equipment, or other property offered to us.

These terms apply when you use this website, request a pickup, arrange a drop-off, or give Items to us. By offering Items or checking the acceptance box on a form, you agree to these terms. If you act for another person or organization, you confirm that you are authorized to bind that owner.

2. Fundraiser status

Cline's Recycling is a family fundraiser supporting Sophia's continuing medical and care-related needs; it is not a municipal waste service. Unless we expressly provide documentation stating otherwise, do not assume that an Item donation is tax deductible. You are responsible for obtaining independent tax advice and keeping any records required for a claimed deduction.

3. Your ownership and authority

For every Item you offer, you represent and warrant that:

We may ask for identification, proof of ownership, a title, a bill of sale, or written authorization. We may refuse, isolate, hold, or report an Item if ownership is questionable or unlawful activity is suspected, and we may cooperate with law enforcement or a person who establishes a superior legal claim. Our acceptance does not validate a Donor's title.

4. Items we may refuse

A pickup request, appointment, message, or physical delivery does not guarantee acceptance. We may inspect and refuse an Item before or after taking temporary possession. Unless expressly approved in writing, do not offer:

Contact us before transporting an unusual, heavy, regulated, or potentially dangerous Item. Do not leave Items unattended or at an unconfirmed location. An unattended Item is not accepted merely because it was left near our property, and it may be handled as allowed by law.

5. Acceptance and transfer of ownership

An Item is “Accepted” only when an authorized Cline's Recycling representative knowingly takes physical possession and confirms acceptance. Unless applicable law requires otherwise, at that moment you irrevocably transfer to Cline's Recycling all of your right, title, and interest in the Accepted Item, without payment or continuing control. Accepted Items generally will not be returned.

After acceptance, we may inspect, clean, repair, combine, dismantle, reuse, resell, donate, recycle, or responsibly discard the Item in our discretion. Any proceeds belong to the fundraiser and may be applied to fundraiser operations and Sophia's medical and care-related needs. No particular resale price, use, recipient, recycling method, or financial result is promised.

Ownership and responsibility for a refused Item remain with the Donor. If we later determine that an Item cannot lawfully or safely be handled, we may revoke acceptance where the law permits and require the Donor to retrieve it or pay reasonable handling, return, remediation, or disposal costs.

6. Pickup, drop-off, and access to property

When requesting pickup, you confirm that you own or control the pickup location and are authorized to let us enter the designated area. You must accurately identify the Items, disclose known hazards, provide safe and reasonable access, secure animals, and identify property that must not be removed. We may cancel or stop work when conditions are unsafe or materially different from what was described.

We will use reasonable care, but we are not responsible for pre-existing damage, ordinary wear, concealed conditions, or damage caused by inaccurate instructions, unsafe access, or a Donor's breach of these terms.

7. Personal information on donated Items

Before donating, remove papers, account credentials, storage media, photographs, and other personal or confidential information. Sign out of accounts and disable activation locks. We do not promise data recovery, secure erasure, or return of information left on an Accepted Item.

8. Fundraiser purchases: all sales are as-is and final

All products sold by Cline's Recycling are fundraiser items. This includes, without limitation, books, movies, television programs or recorded media, aluminum cans or other metals, wheel rims, electrical or electronic equipment, tools, household goods, parts, and any similar or equivalent product.

Every product is sold as-is, where-is, with all faults. Unless we expressly provide a written warranty at the time of sale, we make no warranty or guarantee about a product's condition, completeness, age, authenticity, compatibility, merchantability, fitness for a particular purpose, resale value, or continued operation. Descriptions and photographs are provided to help identify an item but are not a guarantee of condition. Buyers should inspect an item and determine that it is suitable before purchasing or taking possession.

All fundraiser sales are final. We do not offer refunds, returns, exchanges, credits, or charge reversals because an item is used, imperfect, incompatible, incomplete, or no longer wanted. The buyer assumes responsibility for safe transportation, installation, testing, use, repair, and disposal after taking possession.

Nothing in this section excludes a right or remedy that applicable law does not allow us to waive. If we expressly agree in writing to a different return or warranty term for a particular transaction, that written term controls only that transaction.

9. Payments, third-party services, and lawful funds

We may accept cash and one or more independently operated third-party payment methods. A payer who chooses a non-cash method agrees to that provider's separate terms, conditions, privacy policy, fees, security requirements, and dispute procedures, and agrees to use the service only as intended and lawfully authorized. Cline's Recycling and Cody Cline are not responsible for a third-party provider's availability, decisions, delays, security practices, account restrictions, or independently assessed fees.

A person paying cash represents that every bill and coin tendered is genuine, lawfully possessed, and not counterfeit or altered. We may refuse a payment that appears suspicious and may retain or report suspected counterfeit currency as permitted or required by law.

To the extent permitted by law, the payer is responsible for bank charges, returned-payment fees, chargeback costs, collection expenses, and reasonable legal costs actually incurred by Cline's Recycling or Cody Cline because the payer supplied counterfeit funds, made an unauthorized or fraudulent payment, improperly reversed or disputed a valid transaction, or materially violated these payment terms. This provision does not prevent a payer from exercising a legitimate right under applicable law or a payment provider's lawful dispute process.

10. Website and service availability

Website information and fundraiser services are provided on an “as available” basis. We may change accepted categories, pickup areas, schedules, listings, and availability without notice. To the extent permitted by law, we disclaim implied warranties concerning the website or the condition, merchantability, or fitness of donated or resold Items.

11. Hold Harmless

To the fullest extent permitted by law, every Donor and buyer knowingly releases, acquits, and forever discharges Cline's Recycling, Cody Cline, and their family members, volunteers, agents, and authorized representatives from future claims, demands, actions, liabilities, losses, damages, costs, or expenses arising out of or relating to:

Each Donor and buyer agrees to defend, indemnify, and hold harmless Cline's Recycling, Cody Cline, and their family members, volunteers, agents, and authorized representatives from third-party claims and reasonable resulting costs, including reasonable legal fees, caused by that person's breach of these Terms, unlawful conduct, lack of ownership or authority, undisclosed hazard, or misuse of an Item or purchased product.

This section is intended to provide the broadest release and protection permitted by applicable law. It does not release or limit liability that cannot legally be waived, including liability for gross negligence, intentional misconduct, or another obligation that applicable law expressly makes non-waivable.

12. Governing law and general terms

Texas law governs these terms, without regard to conflict-of-law rules. A dispute that cannot be resolved informally may be brought in a court of competent jurisdiction in Texas. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. These terms and any written, service-specific terms are the entire agreement concerning an Item donation.

We may update these terms by posting a revised date. The version in effect when an Item is offered governs that donation.
